The Buy Indian Act: 100 Years of Frustration-And How to Prevent 100 More

Enacted in 1910, the Buy Indian Act is intended to promote contracting by Indian-owned businesses with two federal agencies: the Bureau of Indian Affairs and the Indian Health Service. But the Buy Indian Act has not always lived up to its billing. It took the BIA an incredible 103 years to issue regulations implementing the Act, and a recent GAO report has highlighted additional administrative failings — including a lack of clear guidance about whether Buy Indian Act preferences are supposed to take precedence over other socioeconomic programs.
In this webinar, government contracts attorney Steven Koprince discusses the Buy Indian Act’s history, the long-awaited regulations, and the GAO’s findings. The seminar concludes with a discussion of the future for the Buy Indian Act, focusing on potential improvements (both in the law and its administration) to ensure that Act finally lives up to its promise.
